Terms of Service

Last updated: 6 October 2026

Draft text, not legal advice

This page is a placeholder written as a starting point. The business owner must review it, replace every highlighted value, and have the final wording checked before taking real payments or sending real customer email.

Policy

1. Who these terms are between

These terms are an agreement between you and Sently, which operates the Sently service. In this document "we" and "us" mean Sently, and "you" means the person or organisation using the service.

By creating an account or using the API you accept these terms. If you do not accept them, do not use the service.

2. What the service is

Sently is an email sending API. You verify a domain you control, create an API key, and call our API to send transactional email. We queue each message and deliver it through Amazon Simple Email Service. We record delivery events, such as deliveries, bounces and complaints, and show them in your dashboard.

The service is for transactional and opted-in email. It is not a bulk marketing tool and it is not a mailbox: we do not receive mail on your behalf.

3. Your account

  • You must give an accurate email address and keep it current, because we use it for service and billing notices.
  • You are responsible for everything done under your account, including by users you invite.
  • You must be old enough to enter a contract in India.
  • One person or organisation per account. Do not resell access without our written agreement.

4. Acceptable use

Your sending must follow our Acceptable Use Policy, which forms part of these terms. In short: no spam, no purchased or scraped lists, no phishing or malware, and you must honour unsubscribe requests. We may pause sending on your account automatically if your bounce or complaint rates go above the limits set out in that policy.

5. API keys are your responsibility

An API key allows anyone holding it to send email as your account, at your cost. We show a key once, at creation, and store only a hash of it, so we cannot recover it for you.

  • Keep keys in a secret store or environment variable, never in client-side code or a public repository.
  • Use separate keys per application so you can revoke one without breaking the rest.
  • Revoke a key from the dashboard as soon as you suspect it has leaked, and tell us at [email protected].

Sending done with your key is treated as sending done by you, including usage charged against your plan.

6. Fees and billing

  • All prices are in Indian Rupees (INR) and are shown on the pricing page.
  • Taxes are charged as required by law.
  • Payments are collected by Razorpay. We do not see or store your card details.
  • Paid plans are monthly subscriptions charged in advance. The subscription renews automatically each month until you cancel it.
  • Usage is counted per recipient and resets at the start of each billing month. Sending stops when the plan limit is reached.

Cancellations and refunds are covered by our Refund and Cancellation Policy.

7. Suspension

We may pause sending, suspend an account, or close it if:

  • the account breaks the Acceptable Use Policy or these terms;
  • sending from the account puts our delivery reputation or other customers at risk;
  • payment fails and is not fixed within the grace period described in the refund policy;
  • we are required to act by law or by one of our providers.

Where it is safe and practical we will tell you first and explain what needs to change. For serious abuse we may act immediately.

8. Your content and your recipients

You keep ownership of the content you send. You give us permission to process and transmit it only as needed to run the service. You confirm that you have the right to send to each recipient address you submit. How we handle this data is described in the Privacy Policy.

9. Availability and no warranty

We work to keep the service available and to deliver every accepted message, but email delivery depends on receiving mail servers we do not control. The service is provided "as is" and "as available". We do not promise that it will be uninterrupted, error free, or that any specific message will reach an inbox rather than a spam folder.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, including lost profit, lost revenue, lost data, or business interruption. Our total liability for any claim relating to the service is limited to the fees you paid us in the three months before the event that caused the claim.

Nothing in these terms excludes liability that cannot be excluded by law.

11. Changes to the service and to these terms

We may change the service and these terms. If a change materially reduces what you get, we will give notice by email or in the dashboard before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms. The date at the top of this page shows when it last changed.

12. Ending the agreement

You can stop using the service at any time by cancelling your subscription and deleting your account. We may end this agreement with 30 days notice, or immediately in the suspension cases listed above. When an account is closed we delete its email logs and stored content in line with the Privacy Policy.

13. Governing law

These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute.

14. Contact

Questions about these terms go to [email protected]. Other ways to reach us are on the Contact page.
